The terms for working with Monkay on your website and its hosting.

1. About Monkay
Monkay is a web design and development business based in South Africa. We provide custom websites and web applications, with monthly website hosting, directly to business customers. These terms apply to those services and use of this website.

2. Your project and quote
Website design and development is charged as a one-time project fee, quoted individually. Before work begins, we agree the scope, deliverables, price, payment schedule and estimated timeline in a written quote or project agreement. Additional work or changes outside that scope require a separate agreement on cost and timing.
You are responsible for providing the content, access, feedback and approvals needed for the project. Delays in receiving these may affect the agreed timeline. You must have permission to use any material you provide.
Your accepted project agreement governs project-specific details. It cannot remove rights that applicable law does not allow to be excluded.
3. Hosting and recurring billing
Our advertised website hosting subscription is US$25 per month, billed monthly in US dollars. This is separate from the one-time website build fee. See our pricing page. Maintenance, content changes, domain registration and other additional work are included only when expressly agreed in your quote.
A hosting subscription renews monthly until cancelled. The start date, amount payable and any applicable taxes are set out in your checkout or billing agreement before payment. Any changes to an existing subscription price will be communicated before they take effect so you can decide whether to continue.
4. Payments through Paddle
Where a purchase is completed through Paddle, Paddle acts as the merchant of record and authorised reseller for that transaction, handling payment and billing support. Monkay remains responsible for delivering and supporting the website or hosting service.
For those purchases, the Paddle Buyer Terms and Paddle Refund Policy also apply. Purchases invoiced directly by Monkay follow the payment terms in the accepted quote or invoice.
5. Cancellation and refunds
You can cancel monthly hosting before your next renewal by emailing info@monkay.co. For a Paddle subscription, you can also use the subscription management link in your receipt or visit Paddle support.
Cancellation stops future renewals, with hosting continuing until the end of the paid billing period unless an earlier end is agreed or a refund ends the service. Arrange any website transfer before hosting ends. Cancelling hosting does not cancel a separate website build agreement or amounts already due under it.

6. Website ownership and third-party services
Ownership, licences and handover of the finished work follow your accepted project agreement. You retain rights to content you supply. Third-party software, fonts, images and services remain subject to their own licences and terms; we cannot transfer ownership of those third-party materials.
Hosting and websites depend on infrastructure and services that may sometimes be unavailable. Any specific support commitment or service level must be agreed in writing. Report problems to us so we can investigate.
7. Responsible use
You must not use our services for unlawful activity, infringement, malware, spam or attempts to compromise systems. We may restrict service where necessary to address a security threat, unlawful use or unpaid charges. Where reasonably possible, we will notify you and give you an opportunity to resolve the issue.
8. Privacy, concerns and updates
Our Privacy Policy explains how we handle personal information. If you have a service or billing concern, contact us using the details above. Nothing in these terms limits any mandatory consumer, privacy or other statutory rights.
We may update these terms for future services and will identify changes using the date above. Changes do not retrospectively replace an accepted project agreement. We will communicate material changes affecting an ongoing subscription before they apply.
